The Seller's warranty period for the Equipment shall be 12 months from the Delivery Date.4.2 During the warranty period, if the Equipment is found to be non-conforming to the Seller's warranty, the Seller shall, at its sole discretion, either repair or replace the non-conforming Equipment or refund the Buyer the purchase price for such Equipment.5. Confidentiality5.1 The Parties agree to maintain the confidentiality of the terms and conditions of this Contract, except to the extent that such terms and conditions are publicly disclosed by a Party in accordance with applicable law or regulation.6.
