法律人不可不读的法官传记

法律人不可不读的法官传记来自: 盒饭 (北京)创建时间: 2011-01-09 20:16:14 最后修改时间: 2012-03-14 15:49:15读一本优秀的人物传记,就像与这个人进行心灵上的对话或交流,无论此人伟大或猥琐,总归会对人有所启迪。
很遗憾,我们这代法律人年轻时,市场上罕有法官传记可读,即使是法学家或律师的传记,也是理论综述多,成长经历少。
2010年,我立下志愿,要主编一套优秀法官传记译丛。
选编标准,一是传主人生经历够传奇,二是由记者或行内人所著,兼顾理论与八卦,可读性较强。
半年来,确定图书、联系版权、寻找译者……经历多番周折,终于确定下6本传记,其中,既有布莱克门、斯蒂文斯这样的自由派大法官,也有伦奎斯特、斯卡利亚这样的保守派大法官,还有勒尼德·汉德等优秀的上诉法院法官。
最迟在2011年6月,第一批法官传记就可以与广大读者见面了。

根据受精时期雄配子进入颈卵器的方式,可将颈卵器植物分为2种类型:第一种为游动精受精植物,这种类型植物受精时,通常在颈卵器周围充满液体,精子释放在颈卵器外,带有鞭毛,通过游动进入颈卵器。
游动精受精植物包括苔藓、蕨类和少数裸子植物[1-2]。
第二种为粉管受精植物,受精时花粉管进入颈卵器,将精细胞释放入卵细胞中。
大部分裸子植物属于粉管受精植物[3]。
成熟的颈卵器结构包括一个卵细胞、一个腹沟细胞(有些植物中退化)和一至数个颈沟细胞(苔藓和蕨类植物)或颈细胞(裸子植物)[2,4]。
其中,颈细胞与卵细胞或腹沟细胞毗邻,是这类植物雄配子进入颈卵器的唯一通道。
自20世纪初至今,国内外许多学者对颈卵器的结构进行了较为广泛的报道,尽管由于实验方法的制约,使得有些观察结果不尽详实,但他们取得的成果为后续研究积累了大量宝贵资料。

My family is from there and we visit my grandparents every summer. I always look forward to the trip because the food in Buenos Aires is sooo delicious!Let me start with one of my favorite things – empanadas! These are little handheld pies that are semi-circular in shape. The dough on the outside is flaky and crispy. But the best part is the delectable filling on the inside. There are all kinds of different empanada fillings like beef, chicken, ham and cheese, spinach, and even sweet ones filled with fruit! My favorite is the carne salada which has seasoned ground beef inside. Empanadas are the perfect snack food. You can eat them on-the-go or enjoy them as an appetizer before a meal.Another classic food from Buenos Aires is the milanesa. This is a thin slice of beef, chicken or veal that has been breaded and fried until it's nice and crispy on the outside. Milanesas are usually served as the main dish with french fries or salad on theside. You can get them plated or made into a milanesa sandwich on fresh bread. Either way, they are crispy, juicy and full of flavor!For lunch, porteños (that's what locals from Buenos Aires call themselves) love to eat sandwiches made with thin crusted bread. My grandpa's favorite is the lomito sandwich. It's packed with delicious fillings like slices of beef tenderloin, ham, melted cheese, tomatoes, lettuce and mayonnaise. Just thinking about it makes my mouth water! Another iconic sandwich is the choripán which has crispy grilled chorizo sausage inside. So simple but so tasty, especially when topped with chimichurri sauce.No meal in Buenos Aires would be complete without empanadas or milanesas. But you know what else I really love? Dulce de leche! This sweet caramel sauce is made from slowly heating sweetened milk until it becomes thick and gooey. Dulce de leche is used as a topping for pancakes, waffles, ice cream, you name it. Sometimes we'll even get medialunas (croissants) from the bakery and dip them right into a jar of dulce de leche for an extra special treat!Those are some of the most iconic and delicious foods you'll find in Buenos Aires. But there are so many other yummy things to try too. From the sizzling grilled meats like bife de chorizo (sirloin steak) to mouth-watering Italian specialties like fugazetta(pizza with lots of onions) that were brought by immigrants. No matter what you order, you can be sure the food will be super fresh since Buenos Aires is known for using high-quality local ingredients.I can't forget to mention the drinks you have to try in Buenos Aires too! When it's hot out, nothing beats an ice cold glass of gaseosa (Spanish for soda). My favorites are naranja (orange) and pomelo (grapefruit). For a warm treat, you've got to order a chocolatada or hot chocolate made from rich, velvety Argentine chocolate. And of course, no Argentine is going to turn down a chance to sip on their national drink called mate, a kind of tea made from yerba leaves. You may have to acquire a taste for that strong, bitter flavor though!I really could go on and on about all of the amazing food in Buenos Aires. From the tender asado (barbecue) to the sweet and sticky facturas (pastries), there's just so much deliciousness to discover! I'm lucky that my family is from such an incredible food city. By Joan Biskupic, USA TODAY报刊Several Supreme Court justices challenged a California official's attempt Tuesday to defend a ban on violent video games for minors in one of the more engaging —and amusing — sessions at the high court in years. From Grimm's Fairy Tales to the Vulcans of Star Trek to the Mortal Kombat video game, the justices raised examples of violence that might concern parents yet also might be shielded from regulation based on First Amendment speech rights.Some, such as Justice Antonin Scalia, emphasized the value of violence in American culture and suggested that all video games should be protected by the First Amendment, as the lawyer representing industry groups asserted Tuesday.Scalia challenged the notion that "deviant" violence could be defined in law and posed a scenario in which some parents might be perfectly content to have their children watch violence. "They like gore," he said and quipped, "They may even like violent kids."SUPREME COURT: Case on violent games tests speech limitsBACKGROUND: "Friend of the court" briefs related to video game caseCOURT: More on major court cases, justicesOthers, such as Justice Stephen Breyer, expressed revulsion at some of the violence in today's video games and raised a hypothetical question involving "gratuitous torture … of babies." Breyer said that if parents want their children to play such games they should go buy the games for them.Though the justices peppered both sides with questions, they showed greatest skepticism for the state's argument that government should be able to restrict minors' access to violent video games, as the Supreme Court has long allowed regulation of minors' access to sexually explicit materials.Key justices across the ideological spectrum, including conservative Scalia, liberal Ruth Bader Ginsburg and moderate conservative Anthony Kennedy, expressed concerns that the California law, which has never been enforced, infringed free speech.Kennedy said, "For generations there has been a societal consensus about sexual material" being exempt from some First Amendment coverage. "You're asking us to go into an entirely new area where there is no consensus."The case could have wide consequences for the entertainment industry and consumers. California officials say the ban was intended to protect children and help their parents. They say it was narrowly written to avoid infringing on adults' viewing. Video game producers and vendors counter that the law sweeps too broadly and stress that they have a voluntary system in place that helps parents choose what their children should watch.The dispute has drawn 30 sets of "friend of the court"briefs from outside groups, 26 of them from advocates siding with the video game industry and representing publishers, filmmakers, cable companies and others warning against a decision that would limit speech rights and possibly affect what is shown in films or other media.After California Gov. Arnold Schwarzenegger, a Republican, signed the law in 2005, it was immediately challenged by the video game industry. The U.S. Court of Appeals for the 9th Circuit declared the law unconstitutional on First Amendment grounds, echoing other lower courts that have considered similar state laws.The 9th Circuit noted that the Supreme Court has repeatedly rejected a First Amendment exception for violent materials, although it has allowed an exception for sexually explicit materials, as in a 1968 case involving a prohibition on the sale of "girlie magazines" to minors.Appealing the 9th Circuit decision, California DeputyAttorney General Zackery Morazzini stressed Tuesday that state officials were "no less concerned with a minor's access to the deviant level of violence" than they are about their access to sexual materials.He said the ban was intended to permit parents "to direct the upbringing of their children" and help parents when they cannot be present in the home."Some of the Grimm's Fairy Tales are quite grim, to tell you the truth," Scalia said. He suggested by his questions that violence —unlike sexual activity —should not be regulated. He said he was concerned that manufacturers would not know what games would get them into trouble.Of fairy tale, comic book and video game violence, Ginsburg asked, "What's the difference?"Morazzini said it is the interactive nature of video games that make "the young adult the aggressor."Elena Kagan, the court's newest justice, challenged Morazzini on his assertion that studies show video games harm children. She asked whether Mortal Kombat, which she described as an "iconic game" that about half the law clerks in the building knew how to play, would be covered by the ban.Morazzini said the game could be a candidate for restricted access. Justice Sonia Sotomayor asked whether a video game that involved the torture of "a Vulcan, as opposed to a human being" would be covered by the law. Morazzini said no because the ban targets only videos in which humans are assaulted.Washington lawyer Paul Smith, arguing on behalf of the Entertainment Merchants Association and the Entertainment Software Association, faced tough questions, too, particularly from Breyer, Chief Justice John Roberts and Justice Samuel Alito.Smith said the state was attempting to offer a "new free pass" in the First Amendment area for certain video games. He emphasized that the industry puts labels on videos assessing the level of violence and indicating age-appropriateness.Breyer suggested it simply made "common sense" to keep children from engaging in games that allowed them to torture and kill. "What's the difference between sex and violence," when it comes to potentially harmful effects on children, he asked.Breyer acknowledged that studies in the area were not conclusive, yet said there was enough indication that violent video games have a "tendency to increase violence." He asked why the court would not defer to the interest of California's elected legislators.Roberts and Alito said the medium might be different enough to allow regulation because in it, the child controls the maiming and killing. Roberts scoffed when Smith referred to parental controls. "Any 13-year-old canbypass parental controls in about five minutes," the chief justice said.Roberts read a particularly graphic description from the activities in the Postal 2 game in which schoolgirls beg for mercy, are decapitated, doused with gasoline and urinated on."We protect children from that," he said. "We don't actively expose them to that."Roberts noted that governments have been allowed to draw lines between minors and adults, for example, for the death penalty and prison terms.Smith said those cases did not involve free expression protected by the First Amendment.The ban prohibits the sale or rental of "violent video games" to anyone under 18. The law defines a violent video game as one that depicts "killing, maiming, dismembering or sexually assaulting an image of ahuman being" in a way that: 1) a reasonable person would find appeals to a deviant or morbid interest of minors; 2) is patently offensive to prevailing standards in the community as to what is suitable for minors; 3) causes the game, as a whole, to lack serious literary, artistic, political or scientific value for minors.The law added a labeling requirement: Anyone who imports into or distributes within California a "violent video game" must place a 2-inch-square "18" label on the front of the game's packaging.The law calls for a fine of up to $1,000 on anyone who violates the ban.Other states are divided on California's effort. Eleven states back California and nine are opposed, asserting that such a ban would draw law enforcement resources away from more urgent safety concerns.A decision in the dispute is likely by next summer when the justices recess for the term.。
