准许同性婚姻的理由
第一、根据现行法律，同性恋不违反中国法律，同性恋者是具有 各项权利的中华人民共和国公民。
第二、鉴于同性恋者属于少数族群，许多国家已设立反歧视的保护 性法律。
第三、由于同性恋者的关系没有婚姻形式加以束缚和保障，容易造成 一部分同性恋者交友随意，增加性病传播的可能性。
第四、我国有保护少数族群和弱势群体利益方面的成功经验。对于同性 恋这个处于弱势地位的少数族群的保护将使我国的形象更为开明、进步， 造成一种各社会群体之间更为宽容、和谐的气氛，有利于国家的形象和 社会的稳定。
首先可喜的是，1997年中国废除了鸡奸罪，使自愿的同性 恋性行为不属于是违法行为。
2001年中国精神病学会颁 布《中国精神病分类与诊 断标准》（第三版），不 再把同性恋统划为病态， 所以同性恋者的刑事责任 能力与其他人不应有所区 别。

容易通过性方式感染艾滋病的人群有以下两个特征 ： 1、多性伴 2、无有效的保护措施
男同性恋由于多种原因，部分人群在一定阶段存在着多 性伴的情况；又由于以前性安全没有被充分重视起来， 而同性之间不存在避孕的问题，所以，安全问题一直就 是同性恋人群所忽视的。艾滋病患者中，同性传播所占 比例从8%上升为36.9%，排第一位。
